Understanding the AARTO Demerit POint System
From 1 July 2026, the AARTO system will come into full effect across South Africa. This new administrative approach to traffic offences introduces a demerit points system designed to improve road safety, enforce compliance, and streamline the management of traffic infringements. For fleet operators, drivers, and companies, understanding both how demerit points are allocated and the consequences of exceeding thresholds, is critical.
The 15-Point Threshold: Who and What It Affects
Under the AARTO regulations, both natural persons (individual drivers) and juristic persons (companies or organisations) can accumulate demerit points. Exceeding 15 points triggers disqualification, either of the individual driver or of the vehicle’s ability to operate on public roads.
Impact on Individual Drivers
For individual drivers, demerit points are tied directly to their personal driving record. If a driver commits an infringement, or if a vehicle owner fails to nominate the person who committed it, the points are recorded against their driver’s licence. If an individual surpasses the 15-point threshold, they must surrender their driver’s licence, learner’s licence, or professional driving permit and may not operate any motor vehicle for the duration of the disqualification period.
Impact on Companies and Fleet Operators
For juristic persons, points are linked to the asset rather than a person. Points are allocated either to the operator card or the motor vehicle licence (MVL) disc. If the vehicle or company asset exceeds the threshold, the vehicle is disqualified, and the associated MVL disc or operator card must be removed and destroyed. The vehicle may not be driven on public roads for the duration of the disqualification period.
Companies must ensure that infringements are nominated to the responsible driver to ensure that demerit points are transferred accordingly. Failing to monitor driver behaviour, nominate fines, or maintain accurate driver records can result in vehicle disqualifications, administrative blocks, and operational disruptions.
